Jean or Jane Piper 1794-1868

Jane Piper 1794-1868

Jean/Jane is the sister of my 4th grandfather .
She remained single and was a domestic all her life but is the only member of the family to accumulate enough to require a will. This will was written shortly before her death.
It is from this will that I learned of 2 more siblings not found in the parish records.

Testament By Jane Piper
At Ayr the eighth day of December Eighteen hundred and sixty eight years compeared David Dunlop Solicitor in Ayr who produce Inventory of the Personal Estate of the deceased Jane Piper after designed; also Testament by the deceased and of which Testament the tenor follows
I Jane Piper residing at Sundrum Mains in the parish of Coylton and shire of Ayr, being resolved to settle my affairs in order to prevent disputes after my death, do hereby make, constitute and appoint Hugh Wallace residing at Sundrum Mains aforesaid, son of my sister Margaret Piper or Wallace, whom failing Jane Wallace if the said Hugh Wallace, whom failing Archibald Wallace after designed to be my sole Executor with full power to him to intromit with the whole moveable and personal estate which shall belong to me at the time of my death, to give up Inventories there of to confirm the same, and generally to do everything in the premises competent to an Executor. And I appoint my said Executors in their order after paying my lawful debts and funeral charges and the expense of recovering and confirming my estate to make payment of the following legacils at the first term of Whitsunday or Mrtinmas after my death, or as soon thereafter as possible viz. To my niece Jane Murray residing in Newton upon Ayr, daughter of my late sister Euphemia Piper and her heirs Executors or successors the sum of Twenty pounds Stirling. To my niece Jane Wallace eldest daughter of my said sister Margaret, residing at Sundrum Mains afore said and her heirs executors and successors the sum of Twenty pounds Stirling and to deliver to her the whole of my body clothes, household furniture and  phneshing and other moveables whtatsoever, except cash only. To my nephew Hugh Piper, residing at Bridge of Coil, in the said parish of Coylton, only son of my late sister Jane Piper, and his heirs, executors or successors the sum of Twenty pounds Stirling, To my nephew Robert Wallace residing in Carrick Street, Ayr, second son of my said sister Margaret and his heirs executors or successors, the sum of Twenty pounds Stirling. To my nephew the said Hugh Wallace Executor appointed herein and his heirs, executors and successors the sum of Five pounds Stirling. To my nephew Archibald Wallace residing at Burnside of Sundrum , in the said parish of Coylton son of my said sister Margaret and his heirs Executors or successors Five pounds Stirling. To my niece Janet Wallace residing in Wellington Square, Ayr, daughter of my said sister Margaret and her heirs executors or successors, the sum of Five pounds Stirling. To Hugh Wallace only son of said niece Jane Wallace residing at Sundrum Mains aforesaid and his heirs, Executors or successors the sum of Five pounds Stirling, And whatever residue there may be of my means and estate after the above payments and after delivery as aforesaid I ordain my said Executors in their order to deposit in the Union Bank at Ayr in their names in trust for the aliment of my said sister Margaret and her imbecile daughter Margaret Wallace and the survivor of them, and should my sister Margaret and her said daughter Margaret both predecease the said Hugh Wallace Executor appointed herein then each portion of the said residue as shall at the death of the last survivor of them be remaining shall vest in the said Hugh Wallace Executor as his own.
And should the said Hugh Wallace Executor died before his mother sand his said imbecile sister then the other Executor hereby appointed shall hold the said residue departed as aforesaid for their aliment and support and the aliment and the support of the survivor of them as aforesaid and on the death of the last survivor of them he shall pay any portion of my said residue that shall then remain to the Legatees herein before named in equal shares or to their respective heirs and executors and that per stirpes. And I declare that all bequests hereby made so far as in favour of or descending upon females shall be exclusive of the just mariti  and right of administration of any husband they have married or may marry. And that the legacy of Twenty pounds bequeathed to the said Hugh Piper shall be paid free of legacy duty, And this I declare to be last Will and Testament . And I consent to the Registration hereof in the Books of Council and Session or others competent for preservation and for that purpose I constitute my executors. In witness Where of these presents written on the face of this sheet of paper by John Douglas Apprentice to David Dunlop, Solicitor in Ayr are subscribed by my at Sundrum Mains aforesaid the twenty eighth day of October One thousand eight hundred and sixty eight years before these Witnesses James McKelvie residing at Sundrum Cottage, Coylton and Archibald Ainole residing in Ayr, Apprendice to the said David Dunlop. Declaring that the words “Jane Wallace Sister of the said Hugh Wallace, whom failing Archibald Wallace after designed” on the third and fourth line from the top hereof and the words “ the Legatees herein before named in equal shares or to their respective heirs and Executors and that “for stirpes” on the twenty eighth and Twenty nine lines from the top hereof were written by the said David Dunlop before subscription . At the desire of the above named and designed Jane Piper and by authority from her, who declared that she cannot write never having been taught so to do and she having in token of the authority given to me touched my pen. I David Dunlop Solicitor in Ayr Notary public in the premises do subscribe for her, the before written Deed having been preciously read over to the said Jane Piper in presence of me and of the Witnesses before designed (signed) Lotis Manibus D.Dunlop, Notary Public. In presence of Alexander Boyle, Captain in the Royal Navy, One of Her Majestys Justices of the Peace for the County of Ayr Appeared Hugh Wallace , residing at Sundrum Mains aforesaid son of Margaret Piper or Wallace the defuncts sister, Executor of the said deceased Jane Piper, who being solemnly sworn and examined Depones That the said Jane Piper died at Sundrum Mains aforesaid on the tenth day of November, Eighteen hundred and sixty eight, and the Deponent has entered upon the possession and management of the deceaseds estate as Executor Nominated by her in a General Disposition and Deed of Settlement executed by her upon the twenty eighth day of October Eighteen hundred and sixty eight. Non exhibited and signed by the Deponent and the said Alexander Boyle on this date as relative hereto: That the Deponent does not know of any Settlement or Writing, relative to the disposal of the deceased personal estate or effects or any part there of, other than that non exhibited : That the foresaid  Inventory signed by the Deponent and the said Alexander Boyle, as relative here to is a full and complete Inventory of the personal estate and effects of the said deceased Jane Piper, whensoever situated and belonging or due to her beneficially at the time of her death in so far as the same has come to the Deponents knowledge: That the deponent does not know of any money or property belonging to the deceased liable to the duty imposed by the Acts Twenty three Victoria caput Fifteen and Twenty three and Twenty four Victoria caput eighty. That the value at this date of the said personal estate and effects in the United Kingdom, including the proceeds earned thereon down to this date is Two hundred and then pounds thirteen shillings and ten pence Stirling and under Three hundred pounds, That Confirmation of the said personal estate is required in favour of the Deponent, All which is truth as the Deponent shall answer to God (signed) Hugh Wallace, Alexander Boyle J.P.
